Who is your landlord?
What is Awaab's Law?
Awaab's Law requires council and housing association landlords in England to investigate and fix certain hazards in their tenants' homes within set deadlines. It is named after Awaab Ishak, a two-year-old who died in December 2020 from a severe respiratory condition caused by prolonged exposure to mould in his family's housing association flat in Rochdale. The coroner's inquest concluded in November 2022.
The rules are set out in the Hazards in Social Housing (Prescribed Requirements) (England) Regulations 2025. They came into force for the social rented sector on 27 October 2025, and are treated as part of every social tenancy agreement.
Last updated 24 October 2026. Based on the government's Awaab's Law Phase 2 guidance for social landlords. The guidance is non-statutory, so the regulations themselves are the legal authority.
Who it applies to
It applies to registered providers of social housing in England: that means local councils and housing associations. It covers almost all social housing let under a tenancy, including temporary and supported accommodation.
It does not cover private landlords, long leaseholds, owner-occupied homes, shared ownership or homes occupied under a licence. We can only help council and housing association tenants in England and Wales. Private renters can get free advice from Shelter.
Which hazards are covered, and from when
The law is being phased in. Landlords must act within the deadlines only for hazards that present a significant risk of harm, or an emergency.

The deadlines landlords must meet
These are maximum timeframes. The clock starts when the landlord becomes aware of the hazard, for example because you reported it.

If the safety work cannot be completed within the timeframes, the landlord must provide alternative accommodation at its own expense. A landlord has a defence if it can show it used all reasonable endeavours to comply (section 10A of the Landlord and Tenant Act 1985).
What you can do if your landlord misses a deadline
1. Put it in writing and keep records
Report the problem by email, letter or your landlord's online portal. Keep copies, dates, photos and any medical notes. This is the evidence of when the landlord became aware.
2. Use the landlord's complaints procedure
Make a formal complaint if the deadlines are missed. If it is not resolved, you can take it to the Housing Ombudsman Service.
3. Take legal advice about a claim
Awaab's Law is treated as part of your tenancy agreement, so tenants can take legal action through the courts for a breach. Time limits apply, so please do not wait. Generally it is up to 6 years for compensation for the disrepair and up to 3 years for a personal injury claim. Common questions about Awaab's Law
Does Awaab's Law apply to my home?
It applies if you rent from a council or a housing association in England. It covers almost all social tenancies, including temporary and supported accommodation. It does not cover private landlords, long leaseholds, shared ownership or homes occupied under a licence.
How quickly must my landlord deal with damp and mould?
If the damp or mould is a significant risk to your health, the landlord must investigate within 10 working days of becoming aware of it, and carry out safety work within 5 working days of the investigation finishing. An emergency hazard must be investigated and made safe within 24 hours.
Can I claim compensation if my landlord breaks Awaab's Law?
Awaab's Law is treated as part of your tenancy agreement, so a breach can be a breach of contract that you can take to court. Whether you have a claim depends on your home, what your landlord was told and when, and the evidence. Checking is free.
What if my landlord says it did everything it could?
A landlord has a defence if it can show it used all reasonable endeavours to meet the deadlines. That is a question of evidence, such as when the landlord was told, what it did and how quickly. A solicitor can look at the facts for you.
Can I claim if I still live in the property?
Yes. You do not need to have moved out to bring a housing disrepair claim. You can claim compensation for the period the disrepair existed and, where applicable, for personal injury caused by the disrepair or damage to your belongings.
How long do I have to make a claim?
Generally up to 6 years for compensation for the disrepair and up to 3 years for a personal injury claim, counted from when the problem should have been fixed. The longer you leave it, the harder it is to prove, so please do not wait. Time limits can be complicated, so ask us about yours.
