The belief that you must leave the Armed Forces before taking legal action is a myth. The three-year limitation period runs regardless, so waiting until discharge risks losing your right to claim altogether.
Your chain of command cannot prevent you from instructing a solicitor, and they have no authority to interfere with your private legal affairs. Frequently asked questions
Will my commanding officer find out about my claim?
No. Your claim is a private legal matter handled entirely between your solicitor and the MoD's dedicated claims department. Your commanding officer will not be informed, your unit will not be notified, and no record of the claim will appear on your service file. Abraham Baron Solicitors manage all communication discreetly, and we never contact your chain of command or your military workplace. Can the military take disciplinary action against me for claiming?
Absolutely not. The law expressly prohibits the Ministry of Defence from taking any adverse action against personnel who exercise their legal right to claim compensation. This includes disciplinary proceedings, unfavourable postings, denial of promotion, and any other form of retaliation. If any such action were taken, it would itself be unlawful and would give rise to a further legal claim. What happens if I am deployed during my claim?
Deployment does not prevent your claim from progressing. Abraham Baron Solicitors handle the entire process on your behalf, and we can communicate with you by email, secure messaging, or telephone regardless of where you are stationed. We regularly manage claims for personnel deployed in the United Kingdom and overseas. If specific steps such as medical examinations are required, we schedule them around your service commitments to minimise disruption.
Will making a claim affect my security clearance?
No. A civil compensation claim against the MoD has absolutely no bearing on your security clearance, whether you hold SC, DV, or any other level of vetting. The vetting process does not consider civil litigation against your employer. Your clearance status will remain entirely unaffected at every stage of the claim, from initial instruction through to settlement or trial. This is a question we are asked frequently, and the answer is always the same — your clearance is safe.
What if I want to leave the military during my claim?
Your claim continues regardless of whether you leave the Armed Forces during the process. If you are discharged or choose to leave, your claim is unaffected because it is a civil legal matter that exists independently of your employment status. In fact, some claimants find that leaving service simplifies certain aspects of the process. Can I claim for an old injury that I sustained years ago while still serving?
Yes, provided you are within the three-year limitation period. The clock runs from the date of injury or, crucially, the date you first became aware that your condition was connected to military service. For gradual conditions such as non-freezing cold injury, hearing loss, or PTSD, this date of knowledge can be much later than the original incident.
