You can still claim compensation after leaving the Armed Forces. The three-year limitation period runs from the date you first connected your condition to military service, not the date of discharge.

Frequently asked questions
Can I claim compensation years after leaving the military?
Yes, many veterans successfully claim compensation years or even decades after leaving the Armed Forces. The three-year limitation period runs from the date of knowledge, meaning the date you first realised your condition was linked to your military service, not the date you were discharged. For conditions such as hearing loss, PTSD, and non-freezing cold injury that are often diagnosed long after service, this means the limitation period may not have started running until recently. How do I get my military medical records?
Your military medical records can be obtained through a Subject Access Request to the Ministry of Defence. Abraham Baron Solicitors handle this entire process on your behalf at no cost. The MoD is legally required to provide your records, and we ensure the request is properly submitted and chased if there are delays. In addition to medical records, we can also obtain your service personnel file, unit records, and any incident reports that may be relevant to your claim.
What is the time limit for veterans to make a claim?
The standard limitation period for a civil compensation claim is three years from the date of your injury or three years from the date you first became aware that your condition was caused by military service. This date of knowledge rule is particularly important for veterans because many service-related conditions develop gradually or are not diagnosed until after discharge. The court also has discretion to extend the time limit in exceptional circumstances. We strongly recommend seeking legal advice as soon as possible to protect your position.
Can I apply for the AFCS after leaving the Armed Forces?
Yes, the Armed Forces Compensation Scheme remains open to veterans for injuries caused by service on or after 6 April 2005. There is no time limit for making an AFCS application, although earlier applications are generally easier to evidence. For injuries caused before 6 April 2005, the War Pension Scheme may apply instead.
